Efeitos patrimoniais do divórcio

Abstract

Este trabalho abordará a partilha do património conjugal após o divórcio, meio de pôr fim à comunhão patrimonial existente no dissolvido casamento. As alterações introduzidas pelo novo regime do divórcio, a restrição ou não da autonomia e liberdade contratual ao impor-se aos ex-cônjuges a partilha não excedendo o que lhes caberia se fossem casados na comunhão de adquiridos, conforme dispõe o artigo 1790º do Código Civil, violando-se assim ou não o regime de bens que fixaram na convenção antenupcial; o estatuto dos bens comuns resultante da nova lei. Far-se-á referência à perda das liberalidades prevista no artigo 1791º do Código Civil. Abordar-se-ão também, a nova figura da compensação que pretendeu atenuar o afastamento da culpa e a sua irrelevância para efeitos patrimoniais, bem como as alterações introduzidas à figura da reparação.

This work address the sharing of matrimonial properity after divorce, middle to end the communion existing equity in marriage dissolved. Approach will be also a new figure of compensation intended to mitigate the removal of guilt and its irrelevance to balance sheets effects, a well as the amendments to the reparation figure.
