Contrato-Promessa

Abstract

A análise do Contrato-Promessa, tema central deste trabalho, levou-nos essencialmente a analisar o seu regime jurídico, pese embora a exposição de síntese que se pretende seja essencialmente sobre o Contrato-Promessa de Compra e Venda, nomeadamente de bem imóvel, não pudemos deixar de aludir a outros tipos de contrato-promessa, que não a de venda, e a outras figuras afins, para destas distingui-lo, com a necessária referência ao contrato de compra e venda, seu negócio jurídico por excelência. Assim, dividimos o presente trabalho em quatro etapas de forma a poder encerrar: a evolução histórica com a sua história legislativa em Portugal, para uma melhor compreensão do tema; a sua estrutura e função, de forma a proceder à análise da sua disciplina jurídica; a possibilidade atribuição de eficácia real à promessa; e posteriormente o regime do sinal e a execução específica, pela importância que todos, Simultaneamente, assumem nesta praxis contratual.

The analysis of the Promissory Contract, which is the main focus of the this work, has taken us to analyze, essentially, its legal system, in spite of the presentation being mainly about the Promissory Contract of Purchase and Sale, namely in which regards Real Estate, we must also refer other types of contracts other than the sale contract to be able to differentiate this type of contract from the rest, and the necessary reference to the Purchase and Sale Contract, your business par excellence. This being said, we will divide the present work in four stages in order to close its historical evolution and the history of the Law in Portugal in connection with it, for a better understanding of the theme; its structure and function, to be able to analyze its legal course; the possibility of attributing real effectiveness to the Promissory Contract and subsequently the deposit terms and specific execution, by the relevance these all have simultaneously in contractual practice.
