Brevíssima História da Cidadania Europeia

Abstract

O Tratado de Maastricht aprovou a mais significativa reforma dos tratados fundadores e conferiu aos cidadãos dos Estadosmembros o direito de também serem cidadãos da União Europeia. O Tratado de Maastricht redimensionou a relevância do indivíduo no processo de integração. O indivíduo foi definido como o fundamento dos tratados. Através de uma revisão bibliográfica, esse trabalho procura descrever brevemente o contexto do surgimento da cidadania europeia e dos direitos inerentes à qualidade de cidadão europeu. O estabelecimento normativo da cidadania da União fez-se ao longo de seis artigos. Entre os direitos políticos revestidos de natureza pública atribuídos aos cidadãos europeus, destacamos o direito de circular e permanecer no território dos Estados-membros, o direito de participação política, o direito de acesso às instituições comunitárias e o direito à proteção diplomática. O direito europeu de proteção diplomática tem uma perspectiva adicional, pois além de representar um direito fundamental da cidadania europeia, também retrata a política internacional da União. Isso indica que o direito europeu de proteção diplomática é inovador. Os demais direitos consagrados no Tratado de Maastricht valeriam mais como princípio de aplicação da liberdade de circulação.

The Maastricht Treaty approved the most significant reform of the founding treaties and gave the citizens of the Member States the right to also be citizens of the European Union. The Maastricht Treaty redimensioned the individual's relevance in the integration process. The individual was defined as the structure of the treaties. Through a literature review, this work seeks to briefly describe the context of the emergence of European citizenship and the rights inherent to European citizens. The normative establishment of the citizenship of the Union was carried out over six articles. Among the political rights covered by a public nature granted to European citizens, we highlight the right to move and remain in the territory of the Member States, the right to political participation, the right to access community institutions and the right to diplomatic protection. The European law of diplomatic protection has an additional perspective, because in addition to representing a fundamental right of European citizenship, it also describes the Union's international policy. This indicates that the European law of diplomatic protection is innovative. The other rights enshrined in the Maastricht Treaty would be better suited as a principle of application of freedom of movement.
