O direito da guerra e a criação de uma jurisdição internacional : uma visão histórico-jurídica em tempos de guerra na Europa

Abstract

Com este estudo pretendemos, de forma sumária, demonstrar, por um lado, que a guerra,desde a Idade Média, não pode ser entendida como um fim em si mesma e que apenas se legitima se realizada a co-berto do direito internacional e para salvaguarda de interesses comuns à comunidade humana e, por outro lado, que foi construído, nos últimos séculos, um sistema de jurisdição internacional para resolução dos lití-gios entre Estados, que pode e deve ser chamado a conciliar os estados e evitar o eclodir de guerras. With this study we intend, in a summary way, to demonstrate, on the one hand, that war, since the Middle Ages, cannot be understood as an end in itself and that it is only legitimate if carried out under the cover of international law and to safeguard common interests to the hu-man community and, on the other hand, that in recent centuries a system of international jurisdiction has been built to resolve disputes between States, which can and must be called upon to reconcilestatesand pre-vent the outbreak of wars.
